1. Acceptance of Terms

By accessing and using WebWatch ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

WebWatch is operated by BEEM Agency Ltd, a company registered in England and Wales ("we," "us," "our," "Company"). These Terms constitute a binding legal agreement between you and BEEM Agency Ltd.

2. Service Description

WebWatch is a SaaS platform that enables photographers and content creators to:

• Upload images for tracking
• Scan the internet for unauthorised use of those images
• View match results and metadata
• Generate evidence exports and takedown notices

WebWatch does NOT:

• Pursue legal action on your behalf
• Serve as a law firm or legal advisor
• Guarantee removal of infringing content
• Provide insurance or indemnification against image theft

3. User Accounts

Account Registration

• You must provide accurate, complete information to create an account
• You are responsible for all activity on your account
• You must keep your password confidential and secure
• You agree to notify us immediately of unauthorised access

Account Eligibility

• You must be at least 18 years old (or the legal age of majority in your jurisdiction)
• You must be authorized to use the images you upload (own or have license to track them)
• You may not use WebWatch for illegal purposes

Account Termination

• We may suspend or terminate your account if you violate these Terms
• You may request deletion of your account at any time by emailing privacy@getweb.watch; we will process account and data deletion requests within 30 days, except where we are required to retain certain records by law (see our Privacy Policy)

4. Image Ownership & Rights

You retain full ownership of all images you upload.

By uploading images to WebWatch, you grant us a limited license to:

• Store your images securely
• Scan them against web content
• Generate match results and metadata
• Create evidence exports for your use

You warrant that:

• You own the copyright to all images you upload, OR
• You have a valid license to track them, OR
• You have explicit permission from the copyright holder

You agree:

• You will not upload images that violate third-party copyrights or rights
• You assume full responsibility and liability for any infringing uploads
• WebWatch is not responsible for determining copyright validity

5. Prohibited Uses

You agree NOT to:

• Upload images that are not your own (unless licensed)
• Use WebWatch to harass, defame, or threaten others
• Attempt to circumvent platform security or access unauthorised areas
• Reverse-engineer, decompile, or modify the Service
• Use the Service for illegal purposes
• Upload child sexual abuse material (CSAM) — we have zero tolerance for this. If we become aware of any such material on our platform, we will remove it immediately, terminate the associated account, and report it to the relevant authorities, including NCMEC where applicable
• Resell, sublicense, or redistribute access to WebWatch
• Scrape data from the platform without permission
• Overwhelm the platform with automated requests

Violation of these terms may result in:

• Account suspension or termination
• Forfeiture of data and credits
• Legal action
• Reporting to relevant authorities

6. Subscriptions & Billing

Free Tier

• No payment required
• Usage is limited by a set of lifetime allowances rather than a single credit balance — currently up to 50 image scans, 50 AI risk analyses, 50 rescans, 50 domain lookups, and 15 takedown notices sent, in total, for the life of your free account
• Tier includes all features listed on our pricing page, subject to the allowances above

Paid Tiers (Starter, Standard, Pro)

• Billed monthly on the same date each month
• Automatic renewal unless cancelled
• Price subject to change with 30 days' notice
• No refunds for partial months or unused credits

Payment & Refunds

• Payments processed via Stripe
• We do not store full credit card details
• Refunds: For billing errors, we'll issue a credit within 30 days. Otherwise, subscriptions are non-refundable
• Chargeback disputes: If you dispute a charge, we may suspend your account pending resolution

Payment Failure

• If payment fails, we'll retry according to our payment processor's standard retry schedule
• Your account may be suspended after 7 days of non-payment
• Suspended accounts may lose access to new scans; existing data will be retained according to our Privacy Policy

7. Feature Limitations & Availability

Service Levels

• WebWatch strives for high uptime but does not guarantee it
• Scheduled maintenance, security updates, and emergencies may cause outages
• We will notify you of planned maintenance in advance where practical

Feature Changes

• We may add, modify, or remove features anytime
• Significant changes will be communicated 30 days in advance
• Critical security changes may be implemented immediately

Scanning Accuracy

• Our perceptual matching technology detects most (but not all) unauthorised uses
• False positives and false negatives may occur
• We are not responsible for matches we miss or incorrect results

8. Match Results & Takedown Notices

Match Accuracy

• We do not guarantee that all matches are accurate
• You are responsible for verifying each match and determining if it's unauthorised
• We are not liable for false positives or missed matches

Takedown Notices

• You are responsible for the content and accuracy of any takedown notices you send
• We provide templates and tools, but you are the sender
• We are not liable for consequences of inaccurate or inappropriate takedown notices
• You agree to comply with DMCA, UK copyright law, and local laws

No Guarantee of Removal

• Sending a takedown notice does not guarantee removal
• Website operators may ignore, dispute, or contest takedown requests
• We do not monitor or verify whether content was actually removed

9. Limitation of Liability

To the maximum extent permitted by law:

WebWatch is provided "as-is" and "as-available" without warranties of any kind.

We are NOT liable for:

• Lost, damaged, or stolen images
• Unauthorised use of your images that we fail to detect
• Inaccurate or missed match results
• Your decision to send takedown notices or pursue legal action
• Decisions made based on WebWatch data
• Third-party actions (website operators ignoring takedowns, etc.)
• Indirect, incidental, or consequential damages (lost revenue, business interruption, etc.)

Our total liability to you in any month shall not exceed the fees you paid that month.

10. Indemnification

You agree to indemnify and hold harmless BEEM Agency Ltd and WebWatch from any claims, damages, or costs arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of third-party rights
• Content you upload (images, metadata, takedown notices)
• Your legal action or disputes with other parties

11. Intellectual Property

WebWatch IP

• The WebWatch platform, interface, algorithms, and branding are owned by BEEM Agency Ltd
• You may not copy, modify, or use them without permission
• Your use of the Service grants you a limited, personal, non-transferable license

Your Content

• You retain ownership of images and data you upload
• BEEM Agency Ltd retains ownership of anonymized analytics and platform improvements

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of England and Wales.

Jurisdiction

Disputes shall be resolved in the courts of England and Wales.

Disputes Process

• Before legal action, you agree to contact us to attempt resolution
• Email: help@getweb.watch with a detailed description of the dispute

No Class Actions

• You agree not to bring class action or collective claims against WebWatch or BEEM Agency Ltd
• All claims must be brought individually

13. Privacy & Data Protection

Our handling of your personal data and images is governed by our Privacy Policy. By using WebWatch, you consent to our data practices as outlined there.

14. Modifications to Terms

We may update these Terms anytime. Material changes will be notified 30 days in advance. Continued use of the Service after changes constitutes acceptance.

15. Severability

If any part of these Terms is found unenforceable, the rest remains in full effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BEEM Agency Ltd. Any prior agreements are superseded.
